Conditions of purchase and use of the website.

1 – The Website Operator

The seller of the products and Operator of the website https://www.appenninofoodshop.com/ is Appennino Food Group spa, Via del Lavoro 14/b, 40053 Valsamoggia, Italy, VAT no. 2 – Field of application

These conditions regulate the sale of products on the website www.appenninofoodshop.com(the version published at the time the order is made).

The products offered for sale on the website www.appenninofoodshop.comare aimed solely at natural persons who are not engaged in trade within the field of their own business, and can therefore be qualified as “Consumers”.

By placing an order, the User declares that they have read all the information provided during the purchase procedure and accept the General Conditions of sale in their entirety.

3 – Registration

Users who wish to access the site to make purchases must read these General Conditions carefully before placing an order. In order to make use of the website’s services, the User is required to register, truthfully and accurately providing the data requested on the registration form and accepting the Privacy Policy and these General Conditions. Users are responsible for safeguarding their credentials, and shall be the sole party responsible for all activities performed with them.

4 – Products

Information on the contents of the boxes offered for sale is available on the web page dedicated to each box (hereinafter referred to as Product). The images depicting each element contained in the products for sale correspond to a photographic representation of the element itself. 5 – Purchase Procedure

Prices are given in Euros (€), inclusive of VAT at the prevailing rate. Shipping costs are not included in the individual product prices, and will vary depending on the purchase amount and delivery destination, and are therefore expressly indicated in the order summary. In order to complete the purchase procedure, the User must select the product, add it to their cart and complete the check-out process by entering their shipping and billing details before choosing the payment method. A contract is entered into following payment of the purchase price and shipping fees indicated in the order summary form. Once the transaction has been confirmed, an order confirmation message will be displayed check that the confirmation has all these elements: no. + date of order + products + qty and price + shipping cost + order total. Orders cannot be cancelled. Once the Operator has received the order, it shall be considered final and the products will immediately be prepared for shipping; any additions will be treated as a new order.

6 – Delivery Terms

For orders received before 12:00 a.m., except in the event of accidents or force majeure, national/local holidays, remote delivery locations, or delays due to the delivery company, delivery will be made within: Italy (mainland) 24/48 hours Italy (islands) 48/72 hours Orders received after 12:00 will be shipped the working day following the date of the order. Orders received on Saturday or Sunday, or on public holidays, will be processed the working day following the date of the order. .

7 – Methods of Payment

The methods of payment available to the User are described on the order page (PayPal, credit card or other electronic payment systems). The Site Operator does not have access to the payment data provided by the User and the site does not store credit card details.

8 –Payment Receipt

For each order placed, the Operator will issue a receipt which will be received by the customer upon collection of the goods.

9 – Delivery

Local deliveries – within the provinces of Bologna and Modena – will be made, where possible, directly by the Operator, using its own carrier. Shipments to the rest of Italy (including the islands) will be made by an express courier to the specified destination during working hours, in accordance with the timeframes given on the order form, excepting delays or unexpected issues which are not dependent on the Operator itself. The delivery times, where possible, will in any case be specified on the order form, with the exception of delays or unexpected issues outside of the control of the Operator. The Operator shall not be responsible for lack of delivery or late delivery of goods due to imprecise information provided by the User (e.g. incorrect delivery address), or due to problems after delivery or – for shipments outside the provinces of Bologna and Modena – due to delays ascribable to the carrier.

10 – Exclusion of the Right of Cancellation

As the goods are food products which are “liable to deteriorate or expire rapidly”, as they are also subject to alteration due to inappropriate storage, and due to reasons of hygiene and customer protection, the right of cancellation is not applicable. Consumers are therefore able to return purchased goods only in the event of nonconformity of the order or products (i.e. if the product or package is damaged upon delivery or the quantities/type do not match the order placed), in accordance with article 59 of the Italian Consumer Code.

11 –Returns of Nonconforming Products

Consumers are able to return purchased goods only in the event of nonconformity of the order or products (i.e. if the product or package is damaged upon delivery or the quantities/type do not match the order placed) if this is reported at the time of delivery. In the event of returns, the Consumer will be reimbursed using the original payment method, including delivery costs, or the returned goods will be replaced with equivalent products meeting the order specifications. Refunds may be held until the Operator has received the returned goods. If the customer wishes to request a return for the goods received, the items must meet the following requirements: • The items must still have their labels and must be returned in the original packaging without signs of wear. • In the event of nonconforming items, these must be returned without being opened and with guarantee seal still intact. To start a return, carry out the following steps: 1. Access the “returns and refunds” page on the website www.appenninofoodshop.com download the refund request form, fill out all the fields and send it via email to info@appenninofoodshop.com 2. The request will be processed within 24-48 hours, and the User will receive a response.

12 – User Account Closure

The Operator reserves the right to suspend or close User accounts at any time and without prior warning. The Operator reserves the undisputed right to prevent access to the website www.afoodgroup.shop at any time, and without warning, by user accounts which have been subject to payment irregularities or missed payments, repeated order attempts which have not been concluded or any other activity which could explicitly or implicitly lead to direct or indirect damage to the Operator itself.

13 – Prohibited Uses

Users are forbidden from violating, or attempting to violate, the website’s security. Users must not use the website in a manner such as to cause damage to the site itself, or which could hinder its availability or accessibility, and must not use the site in an illicit, illegal, fraudulent or damaging manner. It is also forbidden to reproduce, duplicate, copy or resell the service without the Operator’s express permission.

15 – Protection of the Brand and Site Content

The Operator reserves the right to make modifications to these terms of use at any time, providing notice exclusively on the website itself. Users who continue to access the site following publication of such modifications agree implicitly to the new terms.

18 – Applicable Law and Competent Court

Any sale contract between the website Operator and the User shall be considered to have been made in Italy and shall be subject to Italian law. Users may make use of Alternative Dispute Resolution (ADR) procedures, or may make a claim using the European Union's ODR platform at the following address: https://webgate.ec.europa.eu/odr. Users nevertheless retain the right to appeal to the competent judicial authorities. For the resolution of any disputes involving the interpretation and execution of these conditions or individual purchases, the court of the User’s city of residence shall have sole jurisdiction if located in Italy; in all other cases, or if the purchaser is not a Consumer, the Court of Bologna, Italy shall have sole jurisdiction
